Introduction: This Acceptable Use Policy (“Policy”) governs the use of Xplainity, the AI-powered educational assessment platform provided by Mathfit Education Private Limited (“Mathfit” or the “Company”), operating under the brand name Xplainity (“Xplainity” or the “Platform”). All users of Xplainity (including instructors and students) must adhere to this Policy to ensure a safe, lawful, and respectful environment for oral assessments. By using Xplainity, you (“User”) agree to comply with this Policy and all applicable laws and regulations, including relevant education and data protection laws (such as the EU General Data Protection Regulation (GDPR), India’s Digital Personal Data Protection Act (DPDP), and U.S. educational privacy laws like FERPA, as applicable).
Permitted Uses
- Educational Purpose: Xplainity is intended for legitimate educational assessments, specifically one-on-one oral evaluations between students and instructors. You may use the Platform to conduct or participate in viva-style interviews, knowledge checks, and related academic assessment activities.
- Authorized Participants: Only authorized users may access the Platform. Students should only use Xplainity for assessments they are registered for, and instructors or examiners should use it solely to evaluate their own students or candidates. Account sharing or unauthorized access to another’s assessment session is strictly prohibited.
- Compliance with Law: Users must use the Platform in compliance with all applicable laws and institutional policies. This includes adhering to academic integrity standards and data privacy regulations. For example, do not use the Platform in any way that would violate exam rules, intellectual property rights, or privacy laws.
Prohibited Uses
Users of Xplainity must not engage in any of the following activities:
- Academic Dishonesty: Do not use Xplainity to cheat, plagiarize, or facilitate academic dishonesty. Students must not seek unauthorized help during an oral assessment or impersonate another person. Instructors must not knowingly assist or ignore cheating. The Platform’s purpose is to verify genuine understanding, so any misuse that undermines academic integrity is prohibited.
- Harassment or Hate: Do not engage in harassing, bullying, or discriminatory behavior. This includes any speech or content that is offensive, threatening, or targeted at someone’s personal characteristics (such as race, religion, gender, ethnicity, etc.). All interactions on the Platform (being primarily between student and instructor) should remain professional, respectful, and focused on the assessment.
- Inappropriate Content: Users may not share or vocalize content during assessments that is obscene, profane, graphically violent, sexually explicit, or otherwise inappropriate in an educational context. Content should remain relevant to the academic subject matter. The Company reserves the right to interrupt or terminate sessions that involve prohibited content.
- Unlawful Activity: You must not use Xplainity for any illegal or fraudulent purposes. This includes not uploading or transmitting any malicious code, viruses, or harmful software; not engaging in hacking, penetration testing, or security circumvention on the Platform; and not using the Platform to violate any law or the rights of any person.
- Interference with Platform Integrity: Do not attempt to disrupt or degrade the Platform’s performance. Prohibited actions include overloading the service, conducting denial-of-service attacks, attempting to bypass or disable security or verification features (such as face verification or voice biometrics), or reverse-engineering the Platform’s software, AI models, or algorithms. Users are also forbidden from accessing or attempting to access accounts or data that they are not authorized to access.
- Misuse of Third-Party Services: Xplainity integrates third-party technologies (e.g., video infrastructure by LiveKit, speech-to-text/text-to-speech by Google, and AI models from providers like Google Gemini, OpenAI, and Meta’s Llama, alongside in-house AI models). Users must not misuse these integrated services. For example, you should not attempt to extract data or models from these services, use them outside the Platform’s intended assessment functions, or violate any usage restrictions those third-party providers impose. Any attempt to use Xplainity as a means to access or abuse underlying third-party services is strictly prohibited.
- Unauthorized Data Use: You may not collect, store, or share personal information from the Platform about other individuals (for instance, recording assessment sessions or personal data about a student/instructor) without proper authority. Also, do not input or disclose sensitive personal data on the Platform beyond what is necessary for the assessment. This is to protect everyone’s privacy and comply with data protection regulations.
Enforcement and Consequences
- Monitoring: The Company reserves the right to monitor usage of Xplainity to ensure compliance with this Policy. This may include automated monitoring by AI systems or manual review of assessment session recordings or transcripts, in accordance with our Privacy Policy and applicable laws.
- Violation Response: If a user is found to be violating this Acceptable Use Policy, Mathfit (Xplainity) may take appropriate action. Actions can include a warning, immediate suspension or termination of the user’s account or access, cancellation of an ongoing assessment, and, where appropriate, reporting the misconduct to the relevant educational institution or authorities. Serious violations (such as unlawful acts) may result in the Company cooperating with law enforcement or other regulatory bodies.
- No Waiver of Rights: Failure of the Company to enforce any part of this Policy in every instance does not constitute a waiver of the Company’s rights or remedies.
- Liability: Users are responsible for their own actions on the Platform. Mathfit Education Private Limited shall not be liable for any loss or damage arising from a user’s violation of this Policy. By using Xplainity, you agree to indemnify and hold the Company harmless from any claims or damages resulting from your misuse of the Platform. Contact and Reporting
If you become aware of any misuse of Xplainity or have concerns about content or behavior on the Platform that may violate this Policy, please report it to us immediately. Changes to Policy: Mathfit reserves the right to modify this Acceptable Use Policy at any time. If we make material changes, we will provide notice by updating the effective date above or by other appropriate means. Your continued use of Xplainity after any changes indicates acceptance of the updated Policy.
By using the Xplainity Platform, you acknowledge that you have read, understood, and agree to this Acceptable Use Policy. This Policy is effective as of October 27, 2025, and will remain in effect until updated or replaced by the Company.
